Ontario Law and Snow and Ice Claims

Two Ontario notice rules shape snow and ice claims. Under section 6.1 of the Occupiers' Liability Act, added by Bill 118 and in force since January 29, 2021, a person injured by snow or ice on private property generally must give written notice within 60 days, and that notice can be served on the occupier or the occupier's snow contractor. Sidewalk and Snow Rules in London

Municipal sidewalk rules decide who is expected to clear public walks next to your clients' properties, which can shape both your contracts and your exposure.

Sidewalks. The City of London clears sidewalks after 8 cm of snow and encourages owners to clear in front of their homes. On designated downtown streets listed in Schedule C of Streets By-law S-1, abutting owners must clear the sidewalk before 10:00 a.m. (s. 8.1).

Snow on the road. Streets By-law S-1, s. 8.2, states that no person shall deposit snow or ice on a sidewalk or roadway, which applies to contractors clearing driveways and lots; s. 8.3 also restricts moving snow from private land to the boulevard. The City states that moving snow from a driveway to the street or sidewalk is illegal.
