Ontario Law and Snow and Ice Claims

Two Ontario notice rules shape snow and ice claims. Under section 6.1 of the Occupiers' Liability Act, added by Bill 118 and in force since January 29, 2021, a person injured by snow or ice on private property generally must give written notice within 60 days, and that notice can be served on the occupier or the occupier's snow contractor. Sidewalk and Snow Rules in Windsor

Sidewalks. Windsor By-law 8544 requires residential owners and tenants to clear sidewalks within 12 hours after snowfall or ice forms, and commercial owners and tenants within 4 hours (during daylight, or 4 hours after sunrise for overnight snow or ice). The City does not clear residential or commercial sidewalks.

Snow on the road. The City states that shovelling snow back onto the street is prohibited by the Highway Traffic Act.
