Do I Need Insurance to Plow Snow?

If you are plowing snow for money, even a handful of driveways, the practical answer is yes. The legal answer is more nuanced, and it helps to separate the two.

This is general information, not legal or insurance advice.

What the Law Requires

Vehicle insurance is mandatory. Every vehicle driven on public roads in Ontario, British Columbia, Alberta and Saskatchewan must be insured. The question is whether your coverage fits commercial plowing. In most cases, plowing for payment is commercial use and should be disclosed to your insurer. See does personal auto insurance cover plowing.

Workers compensation may be mandatory if you have employees, depending on your province and industry classification. See workers compensation for snow removal crews.

Business liability insurance is not required by law for every snow contractor in these provinces. But that is rarely the end of the story.

What Clients Require

Most commercial clients will not hire a snow contractor without proof of liability insurance, and many specify minimum limits and additional insured wording. Property managers, condo corporations, retailers, municipalities and institutions almost always ask for a certificate of insurance. Even some homeowners now ask.

Without insurance, you are limited to the clients who do not ask, which is usually the smallest and least profitable part of the market.

The Real Risk of Plowing Without Insurance

A slip and fall on ice can lead to a lawsuit that names you personally. Without general liability, you would have to pay for your own defence and any judgment or settlement. If your truck damages a car or a garage while plowing, and your auto insurer considers it undisclosed commercial use, you may face a coverage dispute.

For a sole proprietor, personal assets can be exposed. One bad claim can outweigh many seasons of plowing income.

What About Just a Few Driveways?

Part time and side hustle plowers are exactly the group most likely to assume they do not need coverage. The exposure per driveway is lower than a busy plaza, but a single injury or property damage claim can still be significant. See part time and side hustle plowing.
